Bartlett Boater Indicted In Petite Lake Fatal

WAUKEGAN, Ill. (STMW) – A Lake County grand jury approved reckless homicide and aggravated DUI charges Wednesday for the Bartlett man accused of being high on cocaine and under the influence of alcohol when he allegedly ran over a 10-year-old boy with his boat.

David Hatyina, 50, is accused of having a blood-alcohol level between .09 and .128 — above the legal limit of .08 — when Tony Borcia of Libertyville was killed on Petite Lake near Lake Villa on July 28.

The youngster was tubing with his family when he fell off the inner tube and was struck by the speed boat alleged to have been piloted by Hatyina.

Hatyina will enter his plea to the charges at his arraignment Sept. 10.

He is free from custody after having posted 10 percent of a $1 million bond.

Hatyina was arrested for operating a boat while under the influence on Chain O’ Lakes in 1996.

Tony would have been a fifth-grade student at Butterfield School in Libertyville.
